Terms & Conditions
Please read these terms carefully before engaging our remodeling services. By hiring Faithful Build, you agree to these terms and conditions.

1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Faithful Build ("Company," "we," "us," or "our"), a Massachusetts-based remodeling contractor.
By requesting a quote, signing a contract, or engaging our services in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not engage our services.
These Terms supplement but do not replace any written contract signed between you and Faithful Build for specific project work. In case of conflict, the signed project contract shall prevail.
2. Services Provided
Faithful Build provides residential remodeling and construction services throughout Massachusetts, including but not limited to:
- Kitchen remodeling and renovations
- Bathroom remodeling and renovations
- Home additions and ADUs (Accessory Dwelling Units)
- Deck building and outdoor living spaces
- Flooring installation and refinishing
- Roofing installation and repair
- General home remodeling and improvements
The specific scope of work for your project will be detailed in a separate written contract or proposal. We reserve the right to decline projects that fall outside our expertise or service area.
3. Contracts and Pricing
3.1 Fixed-Price Contracts
We primarily operate on fixed-price contracts, where the total project cost is agreed upon before work begins. This price is based on the scope of work detailed in our proposal and is subject to change only under the following circumstances:
- Client-requested changes to the original scope (change orders)
- Discovery of unforeseen conditions (e.g., hidden structural damage, code violations)
- Required permits or code compliance updates not anticipated in the original proposal
- Material substitutions requested by the client
3.2 Estimates and Quotes
Estimates provided during initial consultations are preliminary and non-binding. A formal written proposal with fixed pricing will be provided after a detailed site assessment. Quotes are valid for 30 days from the date of issue unless otherwise specified.
3.3 Change Orders
Any changes to the original scope of work must be documented in writing through a change order signed by both parties. Change orders will detail the additional work, associated costs, and any impact on the project timeline. Work on change orders will not commence until the change order is approved and signed.
4. Payment Terms
4.1 Payment Structure
Payment schedules are structured based on project size and scope. Typical arrangements include:
- Initial Deposit: Required to secure project scheduling and begin material procurement
- Milestone Payments: Subsequent payments tied to specific project milestones (e.g., demolition complete, framing complete, final inspection)
- Final Payment: Due upon substantial completion and client walk-through
The specific payment schedule will be outlined in your project contract. Payment terms may vary based on project complexity and duration.
4.2 Non-Refundable Deposit
The initial deposit covers design consultation, project planning, permit applications, and material ordering costs. Deposits are non-refundable once design and planning work has commenced or materials have been ordered. This policy ensures we can commit our time and resources to your project.
4.3 Late Payments
Payments are due according to the schedule outlined in your contract. Late payments may result in:
- Work stoppage until payment is received
- Late fees of 1.5% per month on outstanding balances
- Collection costs and reasonable attorney fees if collection action is required
4.4 Accepted Payment Methods
We accept checks, bank transfers, and major credit cards. Credit card payments may be subject to a processing fee. Specific payment methods accepted will be outlined in your contract.
5. Warranties and Guarantees
5.1 Workmanship Warranty
Faithful Build stands behind our work. We provide workmanship warranties that vary by service type. The specific warranty terms for your project will be detailed in your contract and may include:
- Coverage for defects in installation or craftsmanship
- Warranty period based on the type of work performed
- Exclusions for normal wear and tear, client misuse, or acts of nature
5.2 Manufacturer Warranties
Materials and products installed are covered by their respective manufacturer warranties. We will provide you with all applicable warranty documentation. Manufacturer warranties are separate from our workmanship warranty.
5.3 Warranty Exclusions
Warranties do not cover damage resulting from: misuse or neglect, unauthorized modifications, failure to maintain as recommended, natural disasters or acts of God, normal settling of structures, or pre-existing conditions not addressed in the original scope of work.
6. Project Timeline and Delays
6.1 Estimated Timeline
Project timelines provided in proposals are estimates based on current conditions and information available. While we strive to meet all deadlines, construction projects can be affected by numerous factors outside our control.
6.2 Force Majeure
Faithful Build shall not be liable for delays caused by circumstances beyond our reasonable control, including but not limited to:
- Adverse weather conditions (rain, snow, extreme temperatures)
- Material shortages or supply chain disruptions
- Permit delays from local authorities
- Required inspections and inspector availability
- Discovery of unforeseen conditions (asbestos, mold, structural issues)
- Utility company scheduling
- Labor shortages or subcontractor delays
- Government actions, pandemics, or civil unrest
In the event of such delays, project timelines will be extended accordingly without penalty to either party. We will communicate any anticipated delays promptly and work with you to minimize impact.
7. Client Responsibilities
To ensure smooth project execution, clients agree to:
- Provide safe and reasonable access to the work area
- Secure or remove valuable personal property from work areas
- Make timely decisions on material selections and design choices
- Be available for scheduled walk-throughs and approvals
- Maintain clear communication with our project manager
- Ensure adequate utilities (water, electricity) are available
- Obtain HOA approvals if required before work begins
- Disclose any known hazardous materials or conditions
7.1 Homeowner's Insurance
We strongly recommend that all clients maintain active homeowner's insurance throughout the duration of the project. Your insurance policy should provide adequate coverage for your property and any unforeseen circumstances that may arise during construction.
8. Permits and Code Compliance
As a licensed contractor in Massachusetts, Faithful Build will obtain all necessary building permits for your project. Permit costs are typically included in the project estimate unless otherwise noted.
All work will be performed in compliance with applicable Massachusetts building codes, local ordinances, and industry standards. If during the project we discover existing code violations that must be corrected, additional costs may apply.
We will coordinate all required inspections with local authorities. Client cooperation and property access during inspections is required.
9. Dispute Resolution
In the event of any dispute arising from or relating to our services:
9.1 Good Faith Negotiation
Both parties agree to first attempt to resolve any dispute through good faith negotiation and direct communication.
9.2 Mediation
If direct negotiation fails, both parties agree to submit the dispute to mediation before pursuing any other legal remedy. Mediation shall be conducted by a mutually agreed upon mediator in Massachusetts. Costs of mediation shall be shared equally between both parties.
9.3 Governing Law
These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
10. Privacy and Data Usage
10.1 Information Collection
We collect personal information necessary to provide our services, including your name, contact information, property address, project details, and payment information. This information is used for project management, communication, and billing purposes.
10.2 Marketing and Portfolio Use
We may photograph or video our completed work for use in marketing materials, including our website, social media, and promotional content. We will request your permission before using identifiable images of your property or including any client testimonials or references.
10.3 Data Security
We implement reasonable security measures to protect your personal information. We do not sell or share your personal information with third parties except as necessary to complete your project (e.g., subcontractors, suppliers) or as required by law.
11. Limitation of Liability
To the maximum extent permitted by law, Faithful Build's total liability for any claims arising from our services shall not exceed the total amount paid by you for the specific project giving rise to the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of profits, or business interruption.
This limitation does not apply to damages resulting from our gross negligence, willful misconduct, or fraud.
12. Insurance and Licensing
Faithful Build maintains all licenses required to operate as a general contractor in Massachusetts. We carry comprehensive insurance coverage including:
- General liability insurance
- Workers' compensation insurance
- Professional liability coverage
Proof of insurance and licensing is available upon request.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Continued use of our services after changes are posted constitutes acceptance of the modified Terms. Material changes will be communicated to active clients directly.

15. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
16. Entire Agreement
These Terms, together with any project-specific contract signed between you and Faithful Build, constitute the entire agreement between the parties concerning the subject matter hereof and supersede all prior or contemporaneous oral or written agreements.
